The UK joins the US in seeking comments on proposed policy changes on the standard-essential patent framework

The UK Intellectual Property Office has requested feedback on whether the Standard Essential Patents ecosystem was “functioning efficiently and effectively and striking the right balance for all” and included questions on competition issues, licensing of SEPs and related litigation.

Sophie Lawrance shares that she has “no doubt there will be a lot of lobbying from both SEP holders and implementers” on the benefits or drawbacks of national courts setting global licensing rates. This comes after the relevant ruling by UK Supreme Court on the Unwired Planet v Huawei case, back in 2020, that made UK Courts more desirable among patent owners.
