21.02.2024

Our EU and UK competition law expert, Sean-Paul Brankin, has been quoted in PaRR’s article on 21st February 2024, ‘OpenAI/Microsoft: EU, UK reviews may have difficulty establishing jurisdiction – analysis’.

The piece summarises ‘whether Microsoft’s investment in the developer of ChatGPT might be reviewable under the EU Merger Regulation, following the UK regulator’s announcement that it too was considering whether OpenAI/Microsoft could be considered a takeover under UK rules.’

  • ‘UK may face lower bar in calling in merger than EC – lawyers
  • CMA may face difficulties demonstrating that it’s not too late to call merger in
  • Agencies should scrutinize fate of Microsoft’s own AI efforts, says group’

Sean-Paul Brankin commented that ‘It’s fair to say that both the CMA and the EC will be pushing the envelope on the definition of control in merger control’.
