Sean-Paul Brankin

Of Counsel – Competition and Antitrust

Sean-Paul is dual English and Belgian qualified and has over 25 years of EU and UK competition law experience as both an advisor and an enforcer. His practice covers complex advisory work, merger control and competition litigation.

Sean-Paul has extensive experience counselling clients in relation to the interaction between IP and competition law and issues arising in relation to potential dominance. He has been involved in contentious matters before the European Commission and UK authorities, has litigated cases before the European Community courts in Luxembourg, the UK Competition Appeals Tribunal and national courts in the UK and elsewhere. He has significant experience in a range of industry sectors including pharmaceuticals, food and FMCG, and financial services. Recent matters include:

  • Obtaining Phase 1 UK merger clearance under a fast-track procedure for the acquisition by a leading pharmacy chain of a competing business, including successfully negotiating cut-down hold separate obligations (excluding upstream wholesale activities) and multiple local divestments under UiL.
  • Obtaining Phase 1 UK merger clearance for the acquisition by a manufacturer with a 90% market share of a company identified as the most likely entrant.
  • Representing clients in the European Courts in relation to pay-for-delay patent settlements.
  • Advising an online platform in relation to its defence of a CMA investigation involving RPM allegations, resulting in no fines being imposed.
  • Advising a leading European supplier of financial services in relation to its successful defence of refusal to supply and price squeezing allegations.
  • Advising the leading supplier of trading terminals across a range of licensing, pricing and supply issues.
  • Advising a globally leading supplier of display technology in relation to licensing and distribution issues.
  • Advising a globally leading gemstone producer on data sharing arrangements relating to a block chain technology platform.

Sean-Paul is a former Legal Director at the Office of Fair Trading, where he was the lead legal advisor to the mergers unit and the head of internal scrutiny.
