Myles Jelf was one of the guests of the newly-launched IPM podcast. The episode was about the Unified Patent Court (UPC) which, if ever launched, will hear cases relating to European patents and the new unitary patent – both administered by the European Patent Office.
With just one nation, Germany, yet to ratify the court,the UK has withdrawn from the agreement. The UK states that “participating in a court that applies EU law and is bound by the Court of Justice of the European Union, would be inconsistent with the government’s aims of becoming an independent self-governing nation.” So to what extent should we anticipate this court coming to fruition?
