Dominic Adair spoke with specialist magazine MIP about the criticism that Justice James Mellor has issued on how to select and instruct expert witnesses.

Dom, who specialises in patent litigation, shared his thoughts on the notes about the lack of relevant practical experience in expert witnesses, which Justice Mellor included in two recent judgments. These were seen by many as a break with the usual attitude from judges who wouldn’t normally criticise the experts directly.

Dominic said that Mellor was likely intending to target solicitors, rather than the expert witnesses themselves, in his criticism of Alcon v AMO Development.
