In August 2016, the US Federal Trade Commission and the Department of Justice’s Antitrust Division published a proposed update to the current US Antitrust Guidelines for the Licensing of Intellectual Property. This article examines the nature and scope of the proposed changes, and goes on to consider some of the similarities and differences between US and EU attitudes to the relationship between IP licensing and competition law.
