We act for both lenders and borrowers on real estate finance transactions, from loan origination to enforcement. This enables our finance practice to see both sides of the lender/ borrower relationship on institutional and unconventional transactions.

We are able to draw on extensive in-house experience in European “Bad Banks”, giving direct insight into the decision making process which precedes enforcement of loans in default.  Our in-house experience also enables us to appreciate the pressures on banks in the lending process, particularly in this heightened regulatory era.  For borrowers, we advise on the full life cycle of the borrowing process, including setting up the most tax efficient funds and providing support at exit.

Bristows’ real estate finance practice has experience of the full lifespan of the lending process, from setting up new funds and SPVs, to negotiating loan facilities and security documents, and advising on enforcement action against defaulting borrowers.

We have a wide network of offshore lawyers with whom we work closely when a party is located in another jurisdiction.
