Chloe’s patent litigation practice has focused primarily on disputes in the life sciences sector, where she has a particular interest as a result of her background in chemistry. As part of her degree, Chloe spent 12 months in the USA working in the R&D team (respiratory medicines) at a global healthcare company and, since qualifying, Chloe was seconded to the IP litigation team of a global pharmaceutical company. The cases Chloe has worked on have involved patents relating to small molecules, antibodies and medical devices.
In addition to representing clients in litigation before the Patents Court (High Court), Court of Appeal and Intellectual Property Enterprise Court, Chloe also coordinates litigation strategy in complex multi-jurisdictional patent disputes. She therefore has experience working with diverse teams of patent attorneys, lawyers and technical experts.
Chloe’s work highlights include:
- Coordinating multinational patent litigation and acting in proceedings in the Patents Court and Court of Appeal in relation to the blockbuster treatment for multiple sclerosis, Gilenya®. This matter also saw multiple courts in Europe consider whether a patent application could be used to obtain a preliminary injunction.
- Acting for Sandoz & Polpharma in patent revocation and infringement proceedings relating to antibody testing patents in the context of a product for the treatment for multiple sclerosis.
- Tehrani v Hamilton – successful defence of an infringement claim in the IPEC and counterclaim for revocation of a patent relating to electronic control systems for hospital ventilators.
- Representing Chiesi Farmaceutici SpA in patent infringement and revocation proceedings in relation to its market leading metered dose inhaler formulation.
Chloe also has experience in the enforcement of Plant Variety Rights, including in compulsory licensing and taking action before customs authorities.
