About the UPC Review of the Year
In our second annual UPC Review publication, we explore the significant case law of the Unified Patent Court (UPC) in the 12 months to November 2025, impacting patent litigation across 18 European states and beyond.
Bristows’ role in the Unified Patent Court
Bristows has been a key player in the UPC’s development, contributing to the Rules of Procedure and leading commentary on the Court’s evolution over the past decade. This has led to Bristows handling multiple cases before different divisions of the UPC. All of our patent litigation partners and many of our associates are authorised to represent clients before the UPC. Together with our UPC Director in our Dublin office, and more than 25 associates in the team, we offer unparalleled experience in European litigation strategy, technical expertise, and commercial insight, making us uniquely equipped to support your UPC needs.

What our UPC Review covers
Our UPC Review explores the case law from the UPC from the last 12 months and covers essential topics such as claim construction, inventive step, infringement under the doctrine of equivalents, indirect infringement, intermediary liability and cross-border jurisdiction, and the role of UPC in resolving FRAND disputes plus many more. We also cover key procedural developments such as decisions on the triggers and urgency for preliminary injunctions, inspection and preservation orders, third party access, expedition and stays, bifurcation and relief. It has certainly been a busy year at the UPC!
Our Review provides clear insight into the UPC’s direction and impact and we look forward to covering all 2026 highlights this time next year.
