On Friday 4 October, Mr. Justice Arnold handed down his judgment in the long-running passing off saga concerning the colour of Sandoz’s AirFluSal Forspiro dry-powder inhaler for the treatment of asthma and COPD.
Bristows acted for Vectura, who was joined to the proceedings as co-defendants for its role in the development of the inhaler.
After a 14-day trial, Mr. Justice Arnold found in favour of Sandoz and Vectura and dismissed all of Glaxo’s allegations of passing off.
