Victoria Rodriguez

Victoria is a dual-qualified solicitor whose experience covers contentious and non-contentious intellectual property matters. She has extensive experience when it comes to brand protection, management, exploitation and enforcement gained as a result of years of managing large international trade mark portfolios for iconic brands.

Victoria has assisted with disputes before the UK Courts, the EU General Court and the UK/EU IPOs and regularly coordinates litigation internationally.

In addition, Victoria has significant experience when it comes to settlements as well as commercial agreements relating to the exploitation of IP rights.

Victoria’s work highlights include:

  • Assisting with an appeal before the High Court which arose in the context of an oppositon. This was the first UK Court decision involving the assessment of distinctiveness and likelihood of confusion concerning collective marks.
  • Advising a leading manufacturer of chocolate and bakery ingredients in relation to a bad faith claim before the UK IPO in the context of the acquisition of trade marks.
  • Coordinating litigation before the German Courts for a leading life sciences company in the context of a complex trade mark infringement claim that included survey evidence.
  • Coordinating litigation before the Japanese High Court for a leading life sciences company. This was a trade mark dispute involving bad faith which set a new precedent in Japan that diverged from the Japanese Office practice.
  • Assisting with an appeal before the EU General Court that arose in the context of an opposition. The particular focus of the case was the application of the ‘independent distinctive role’ in the context of composite trade marks.
  • Managing large international trade mark portfolios including for a leading media company. This includes advising them on the protection of their famous brands, clearance programmes, enforcement and general maintenance of their rights everywhere in the world.

Victoria is a solicitor of England and Wales as well as an Argentinian qualified lawyer. Prior to joining Bristows in 2017 she spent three years working at Berwin Leighton Paisner; before which she worked at the Civil and Commercial Court of Appeals in Argentina for four years.

Victoria is fluent in both Spanish and English.

In addition to her experience in private practice, Victoria has participated in several seminars as a guest lecturer and regularly speaks at conferences/webinars including for CITMA. She writes for Bristows’ Brands Review of the Year, Designs and Copyright Review of the Year as well as for other publications such as the IPSANZ Journal and the CITMA review. Victoria is a member of the Chartered Institute of Trade Mark Attorneys and has in the past formed part of the committee for IPSoc.
