Nick Mercer

Senior Associate – IT & digital projects

Nick has over eight years’ experience advising clients on a wide range of commercial and technology matters, including regulated and BPO outsourcings, cloud contracts, software and IT contracts, AI, contract optimisation, and data and technology regulation.

Nick has extensive experience of advising clients from both a supplier-side and customer-side perspective.

Prior to joining Bristows, Nick spent seven years at a global firm which included secondments to Hong Kong and the Middle East. In addition, Nick has spent time working in-house at, respectively,  an investment manager, social media conglomerate and luxury fashion house.

Nick’s work highlights include:

  • Advising a leading consultancy and technology provider (as supplier) on the outsourcing to it by a global consumer company of its middle and back office functions globally.
  • Advising a leading energy technology provider (as supplier) on the supply of its billing platform to an energy utility company across multiple jurisdictions.
  • Advising a financial institution on the outsourcing of its middle and back office investment functions.
  • Advising a major financial institution on its global facilities management outsourcing.
  • Advising a leading international telecoms provider in relation to the procurement of hardware and software.

Nick has extensive experience of advising financial institutions and asset managers on regulated outsourcings, including compliance with the EBA guidelines, DORA, SS2/21 and ESMA.

He regularly advises on IT and technology aspects of corporate transactions, including both buy-side and sell-side.

Nick also has experience of advising on franchise and distribution agreements.
