We are delighted to be hosting a lunchtime panel discussion during the inaugural London Arbitration Week in conjunction with Oxera.

Arbitration has become the forum of choice for resolving life sciences disputes, where technical complexity, confidentiality, and cross-border dynamics intersect. This session will explore the sector’s distinct challenges, focusing on the interplay between liability and quantum. When collaborations or supply agreements break down, allegations of non-compliance with regulatory or technical specifications often underpin termination. These disputes raise tricky questions around causation, counterfactuals, and valuation.

The panel will examine how to handle these issues and discuss methodologies for assessing reasonable royalties, lost profits, and negotiating damages within the particular economic and regulatory context of the life sciences industry. The goal of the session is to give practical insights on how arbitrators and practitioners can navigate the intersection of science, commerce and regulation that defines modern life sciences disputes.
