AI and IP

The IP issues in AI are front and centre - for tech companies developing AI, and organisations in all sectors using AI tools to create content they seek to own.

In this session we will look at key copyright issues: use of copyright-protected materials to train AI models (input issue), whether AI-generated output infringes copyright in the training data (output issue) and whether copyright exists in outputs (subsistence issue).  

We will also look at key patent issues, including guidance from patent offices, best practice for navigating patentability of AI-based inventions, the UKIPO's approach following Emotional Perception, the landmark series of DABUS cases and emerging legislation.

In this session we will present the results of our benchmarking analysis of the market for GenAI contract terms, looking at the commitments the big providers are giving around IP, use of data, model performance and accuracy, liability risks and more. 

We will also cover emerging best practice when contracting for AI that is regulated by the new EU AI Act – including the scoping, usage and compliance terms relevant to customers and suppliers alike.
