Review of UK & European Trade Marks Cases
Introduction
Another mixed year of some good and some perhaps questionable or unhelpful trade mark decisions.
Our review of 2023 includes cases from the EUIPO on some of the more unusual mark types, sounds and multimedia marks. There is an interesting case on licences and a reminder to future proof them, considering the various changes in circumstance which could come into play. There is a case on the more unusual Reverse Passing Off claim. Also from the EUIPO, we have some additional guidance on where goods or services can be considered similar on account of complementarity and recent cases on genuine use. Finally, the Lidl Tesco dispute played out in the High Court and the Court of Appeal looked at the defence of statutory acquiescence.
